Declaration of Heirs
Puerto Rico laws grant rights of forced heirship in our jurisdiction. Foreigners must abide by the rules of “forced heirship” regarding an estate consisting of real property located in Puerto Rico. The inheritance of such property is regulated by Puerto Rico law. On the other hand, the inheritance of personal property is governed by the law of the jurisdiction where the deceased individual resided or was domiciled. In the absence of a will, a Declaration of Heirs petition must be filed before the Court of First Instance. We represent our clients in the court proceedings to obtain the Declaration of Heirs and assist them in the subsequent administrative proceedings.
